Terms & Conditions of Sale

AGREE TO OUR TERMS & CONDITIONS

By placing an order with calyx le timbre for goods and services, the purchaser agrees to these Terms & Conditions of Sale.

PRICING

Prices listed are LUC.

LUC is Wholesale + WET.

Prices exclude GST.

ORDER QUANTITY

Minimum order is 12 bottles. Split cases are welcome.

DELIVERY CHARGES

Melbourne Metro - free delivery

Sydney, Brisbane - $15 per dozen

If your region is not listed, please ask for rates.

RETENTION OF TITLE

All goods supplied by calyx le timbre remain the property of calyx le timbre, and no title to any supplied goods shall pass to the purchaser until calyx le timbre receives full payment (including any taxes) for those goods. If the purchaser fails to pay the purchase price of any supplied goods before the Required Payment Date, then the purchaser acknowledges and agrees that calyx le timbre (or its agents) may repossess such goods up to the value of the moneys owed (including, without limitation, by entering upon the purchaser's property). "Required Payment Date" means the date notified to the purchaser as the date on which payment is required to be made for the goods supplied by calyx le timbre (and, in the absence of any such notified date, the Required Payment Date is 30 days from the date on which goods are supplied).

DEBT RECOVERY

If any amount due and payable by the purchaser to calyx le timbre remains unpaid more than 15 days after the due date for payment, calyx le timbre may (without prejudice to its other rights and remedies) engage the services of a debt recovery agency, and the purchaser agrees to pay all costs incurred by calyx le timbre in doing so (including, in particular, any commission or fees charged by such agency) in addition to the amount being recovered.

CLAIMS

Upon delivery, all goods will be at the Customer’s risk.

For us to recognise a claim for damage or loss during transport, calyx le timbre must be notified at the time of delivery.

Claims of any other nature will not be accepted unless made within 24 hours of delivery.

CREDIT NOTE POLICY

We are happy to credit any of our wines that can be shown to be defective upon delivery.

We will not credit wines that have been cellared yourself and found to be out of condition when opened, nor will we credit bottles broken on your premises.

All claims for credit must be within 7 days of delivery, and we may request the bottle and original cork back.
